South Korea Proposes New Rules for Cross-Border Crypto Transfers

South Korea has proposed new regulatory requirements for businesses handling cross-border cryptocurrency transfers, introducing mandatory registration, transaction reporting, and enhanced oversight under a framework scheduled to take effect on Dec. 3, 2026.

The Ministry of Finance and Economy has published draft enforcement rules covering international virtual asset transfers, including transactions between domestic and overseas service providers and transfers involving private cryptocurrency wallets. The proposal follows amendments to the Foreign Exchange Transactions Act passed by the National Assembly in May 2026 and promulgated in June, establishing a new category of registered virtual asset transfer businesses.

The proposed framework would bring qualifying cross-border cryptocurrency transfers under South Korea’s formal foreign exchange monitoring system, expanding authorities’ ability to track transactions and identify potential violations.

The public comment period for the draft rules ended on Oct. 26, 2026. The proposal must still undergo regulatory and legislative reviews and Cabinet consideration before implementation.

Crypto Businesses Face New Registration Requirements

Under the proposed framework, businesses conducting qualifying virtual asset transfers would need to register with the finance ministry after satisfying existing virtual asset reporting obligations. They would also be required to connect their systems to the Bank of Korea’s foreign exchange information network and maintain records of relevant transactions.

According to a legal analysis by Bae, Kim & Lee, the draft covers transfers between domestic and foreign virtual asset service providers, as well as transactions between cryptocurrency exchanges and private, unhosted wallets. Authorities are treating certain wallet transfers as potentially producing cross-border effects similar to transactions conducted through overseas financial intermediaries.

The registration requirements would include appropriate information technology systems and at least two qualified employees at each office. Employees would need two years of foreign exchange experience or training approved by the government.

The proposal does not establish a separate minimum capital requirement for businesses registering under the new category.

Cryptocurrency exchanges such as Upbit and Bithumb could fall within the framework when their activities meet the relevant legal definitions. Depending on their operations, the rules could also affect businesses providing digital asset custody, brokerage and related transfer services.

The final scope of coverage will depend on the activities conducted by individual firms and the requirements established in the completed regulations.

Bank of Korea to Collect Transaction Data

Registered operators would submit relevant transfer information to the Bank of Korea’s foreign exchange information system. The data could then be shared with other government and regulatory agencies, including the National Tax Service, Korea Customs Service, Financial Supervisory Service and Korea Financial Intelligence Unit.

The Financial Services Commission would receive delegated authority to administer certain supervisory measures and sanctions, while the Financial Supervisory Service would conduct inspections.

The proposed reporting system is intended to help authorities identify unauthorized foreign exchange transactions, detect attempts to circumvent existing controls, and improve coordination among financial regulators and enforcement agencies.

The framework reflects South Korea’s effort to extend foreign exchange oversight to digital asset transactions that can move value across borders without following conventional banking channels.

For businesses, the new requirements could involve additional compliance costs, technology upgrades and staff training. Firms handling transfers involving overseas platforms or unhosted wallets may also need to review their transaction monitoring and recordkeeping procedures to determine whether their activities fall within the proposed definitions.

Tougher Penalties Target Illegal Remittances

The draft also proposes stronger enforcement measures for money exchange businesses involved in illegal remittances, voice phishing and unauthorized trade payments.

Under the proposed provisions, registration could be canceled following a first qualifying violation, increasing the potential consequences for businesses that breach the applicable rules.

Voice phishing, a form of fraud in which criminals impersonate trusted individuals or institutions to deceive victims into transferring money, remains a concern for South Korean authorities. Regulators are seeking stronger mechanisms to identify suspicious transfers and address the use of financial services for illicit activities.

The proposed sanctions indicate that compliance failures could carry significant consequences for affected businesses. However, the final enforcement provisions will depend on the outcome of the remaining review process.

Implementation Expected in December 2026

The new framework is scheduled to take effect on Dec. 3, 2026, subject to completion of the required regulatory procedures. Certain existing remittance and money exchange businesses would receive a longer transition period, with a compliance deadline of June 30, 2027.

If adopted, the rules would establish a more formal registration and reporting framework for cross-border crypto transfers in South Korea, requiring affected businesses to integrate digital asset transactions into the country’s foreign exchange compliance system.

The proposal could reshape compliance obligations for exchanges, custodians and other virtual asset businesses operating across international markets. Its practical impact will depend on the final rules, the range of transactions covered and how authorities implement registration, reporting and enforcement requirements.
